Effective remedies for EU defence rights

What We Do

Are defense rights granted by EU law to suspects and accused persons in criminal proceedings effective? Do existing judicial remedies ensure the justiciability of such procedural safeguards in the Member States? What standards of protection does the right to effective judicial review entails within the European penal area?

In order to address these questions, the University of Luxembourg is carrying out a research project entitled “Effective defence rights in criminal proceedings: a European and comparative study on judicial remedies” in collaboration with its partners, the University of Gdansk, the University of Leuven, the University of Poitiers, the University of Girona and the University of Saarland.

The primary goal of the study is to improve judicial remedies that ensure the justiciability of the rights of the suspects and the defendants under criminal proceedings within the European criminal justice area. To this end, the research project intends to achieve a better understanding of the structures and the functioning of judicial remedies across Europe, to provide an in-depth knowledge of the existing review mechanisms and practices in six Member States and, finally, to elaborate a European blueprint for the right to effective judicial review in criminal proceedings.
